Obamacare is Unconstitutional

Why the sudden reversal of fortune in healthcare stocks? The answer lies with the U.S. Supreme Court, which held oral arguments this week in the Obamacare case. There are two major constitutional issues under review:

  1. Individual mandate requiring every U.S. citizen to buy health insurance
  2. Severability of Obamacare if individual mandate provision is struck down

Forcing the uninsured to buy insurance would be the first time in U.S. history that a U.S. citizen would be penalized for ?inactivity? ? refusing to buy something they didn?t want. Proponents of the mandate often trot out the regulatory requirement to buy auto insurance, but only people who drive a car are required to buy such insurance; drivers have taken an affirmative action to enter the car market and hence subject themselves to regulation. In contrast, people forced to buy health insurance have done nothing at all except be alive.

Consequently, the individual mandate is a gross abuse of the U.S. Constitution?s Article 1, Section 8, Clause 3 ?Commerce Clause,? which strictly limits federal regulation to commerce ?among the several states.? Ever since Congress passed the McCarran-Ferguson Act in 1945, insurance has always been regulated by the states, not the federal government.

The Supreme Court Will Likely Strike Down Obamacare

Observers of the oral argument have uniformly stated that a majority of Supreme Court justices appeared critical of the individual mandate provision and challenged the government lawyer defending the law much more harshly than they did the arguments of the contesting plaintiff lawyer. Justice Kennedy ? commonly known as the 5-4 ?swing vote? on the bench ? asked the following question of Obama?s lawyer on pages 11-12 of the transcript:

This is unprecedented, this is a step beyond what our cases have allowed, the affirmative duty to act, to go into commerce. If that is so, do you not have a heavy burden of justification?

You are changing the relation of the individual to the government in a unique way. The reason this is concerning is because it requires the individual to do an affirmative act. In the law of torts, our tradition, our law has been that you don?t have the duty to rescue someone if that person is in danger. The blind man is walking in front of a car and you do not have a duty to stop him, absent some relation between you.

Based on academic research, the Supreme Court has historically been much more likely to rule against the side it asks more questions of during oral arguments. A ?state of the art? model based on oral-argument language and tone predicts that the Supreme Court will declare the individual mandate unconstitutional by a slim 5-4 margin.

Obamacare is highly unpopular with the American people. In a recent poll, 75 percent of Americans wanted the Supreme Court to strike it down.? Ironically, even Obama opposed an individual mandate during the 2008 presidential campaign before doing a 180-degree flip-flop once he was elected president. On the other hand, the public overwhelmingly supports barring insurance companies from denying health coverage based on a pre-existing condition by an 85-15 margin.

Pre-Existing Condition Protection Doesn?t Work Without Individual Mandate

The problem is that you can?t have one without the other without destroying the profitability of insurance companies. Absent an individual mandate, the result will be ?adverse selection,? whereby healthy people will opt out of the insurance program while sick people will enroll. A profitable insurance market is based on uncertainty where more people pay into the system than is paid out in claims.? If the only people who enroll are those who are certain to make reimbursement claims based on pre-existing conditions, insurers will end up losing money because the government-regulated insurance premiums won?t be sufficient to cover all of the claims. In their 11th-Circuit Court of Appeals brief (page 30), Obama?s own lawyers have cited Princeton University professor Uwe Reinhardt for the proposition that:

It is well known that guaranteed issue coupled with voluntary insurance tend to lead to a death spiral of individual insurance.

For this reason, the Obama administration has argued that requiring insurance companies to accept pre-existing conditions should not survive if the individual mandate is struck down.

Obamacare Will Be Upheld or Struck Down in Its Entirety ? No Severability

On the third day of oral argument, the issue of severability was debated and my reading of the transcript leads me to believe that many of the justices believe that Obamacare must be struck down in its entirety if the individual mandate is struck down. For example, on page 41 of the transcript Justice Alito asked the best question:

Insurance reforms impose 10-year costs of roughly $700 billion on the insurance industry, and that these costs are supposed to be offset by about 350 billion in new revenue from the individual mandate and 350 billion from the Medicaid expansion. Now if the 350 billion from the individual mandate were to be lost, what would happen to the insurance industry, which would now be in the hole for $350 billion over 10 years?

In Healthcare Reform: the $700 billion Lie, I argued that the cost of Obamacare will be much greater than advertised, but even taking that understated number at face value greatly concerned swing vote Justice Kennedy, who exhibited sympathy for Alito?s question. Kennedy asked a follow-up question on pages 42-43 of the transcript:

I still don?t understand where you are with the answer to Justice Alito?s question. Assume that there is a substantial probability that the 700 billion is going to be cut in half if the individual mandate is stricken. Assume there is a significant possibility of that. Is it within the proper exercise of this Court?s function to impose that kind of risk [on the insurance industry]? Can we say that the Congress would have intended that there be that kind of risk?

I think the reason healthcare stocks have rallied so strongly this week is because investors have concluded that the entire Obamacare monstrosity is going to be struck down ? not just the individual mandate, but also the requirement to enroll people with pre-existing conditions, the expansion of Medicaid, and the medical loss ratio minimums that limit insurance company profits to 20% of insurance premiums collected.

Healthcare Stocks Look Like a Buy

Bottom line: healthcare insurers were going to do fine under Obamacare because the individual mandate and Medicaid expansion requirements promised to greatly increase industry revenues and counteract the pre-existing condition and medical loss ratio cost burdens. Similarly, healthcare insurers will do fine if Obamacare is struck down because free markets allow companies to generate profits unrestricted.

The only scenario where healthcare insurers were going to be hurt badly was if the individual mandate was struck down but the pre-existing condition and medical loss ratio provisions remained (i.e., severability). Since severability is almost certainly off the table given what transpired this week during the U.S. Supreme Court?s oral argument, investors have a ?green light? to invest in healthcare stocks regardless of whether Obamacare is upheld in its entirety or struck down in its entirety.

?All or nothing? ? the key to healthcare profitability ? appears assured.

Thirty-three students at a Jewish girl's school in Crown Heights, Brooklyn ponied up a $100 each after they were stone-cold busted using Facebook. This, after signing a contract with Beis Rivkah High School this year in which they agreed to not use the social network, the New York Daily News reports.

?It?s not a modest thing for a Jewish girl ? or man or woman or student or father to be on," head administrator?Rabbi Benzion Stock told the New York Daily News. "There is a lack of privacy and dignity."

The decree is in keeping with Tzniut, a group of laws emphasizing modesty and humility, and observed within the Orthodox Jewish community. Beis Rivkah is a Hasidic school, but this isn't the first time Facebook, modesty and private schools have clashed.

St. Theresa?s College High?School?in Cebu City in the Philippines?barred a senior from participating in her class's graduation ceremony on Friday because she posted a bikini-clad photo of herself on Facebook.

According to Cebu Daily News,?the girl was "cited for violating five provisions in the [St. Theresa?s College?High?School] Student Handbook" which include a rule against "posing and uploading pictures on the Internet that entail ample body exposure," and "engaging in immoral, indecent, obscene or lewd acts."

The crackdown at Beis Rivkah High School came last week after administrators discovered some of their 495 students still active on Facebook, according to the New York Daily News. Head administrator Stock said parents were "shocked" to learn their daughters were still using the social network.

One sophomore who said she's Facebook friends with her mom, isn't happy with the crackdown. ?If I post a picture, I don?t just send it to everybody," Sarah Freid, 15,?told the New York Daily News. "I don?t do bad things online,? she added. ?I?m friends with my mom.?

All 33 girls were asked to delete their accounts by the end of the week, but they'll get their $100 back at the end of the year.?

Angry Birds Space billed as an educational tool. Really?

Launched Thursday, Angry Birds Space, the latest installment to the wildly popular Angry Birds video game franchise, is being billed as a tool for educating people about physics. How scientifically accurate is the physics in the game?

With over 700 million downloads,?the first Angry Birds game is a testament to the appeal of simplicity. The much-anticipated sequel, Angry Birds Space, which launched on Thursday, looks just as simple, and as freakishly enjoyable.?

But there is one big difference between the original and its high-flying sequel: Angry Birds Space is being billed?as a tool for educating people about physics.

The original Angry Birds allows players to slingshot a variety of ornery avians at oblate green pigs. The pigs have absconded with birds' eggs, hence their anger.

Angry Birds Space incorporates an element of interplanetary gravity. The developers collaborated with NASA to "teach people about physics and space exploration through the internationally successful puzzle game," according to NASA's recent press release.

Peter Vesterbacka, the chief marketing officer of Rovio, which made the game, said in the release that the company couldn't "wait to work with [NASA] on creating more compelling educational experiences."

NASA and Rovio aren't the only organizations touting Angry Birds Space as an educational tool. The Examiner, InformationWeek, and other media outlets have described the game in much the same way.

But is that really true? Is there any educational value in Angry Birds Space??

Before we explore this question, though, let's admit that Angry Birds Space is a game, foremost, and a fun one at that. Perhaps there doesn't have to be any more of a justification to play it, and maybe the excuse of educational value is?unnecessary.

And let's give credit where it's due. The claim that the new game appropriates the concept of microgravity ? the kind of low gravity that affects objects in orbit, like at the International Space Station ? is pretty much true. Also, the game illustrates how objects ? in this case, the birds ? launched in a straight line will curve their trajectories in the presence of massive bodies. So far, so good.?

But when you add audible TNT detonations in space, plants subsisting without carbon dioxide on otherwise forlorn moons, an inexplicable presence of wood and concrete, and the stormy purple vortex at the stroyline's beginning, the educational value of the game falls off dramatically.

The game exhibits more serious problems too, namely, physical impossibilities. Rhett Allain, Associate Professor of Physics at Southeastern Louisiana University and Blogger for wired.com, pointed some of these out.

In the game, the slung birds enter the gravitational fields of tiny pocked moons and plummet toward them. According to Newton's Law of Gravitation, the moons must be extremely massive in order for the birds to move as fast as they do. But the moons aren't all that much larger than the birds themselves. This means that they would have to be extremely dense. Allain calculates one moon's density to be about 7 billion kg/m3 , closer to the density of a white dwarf than that of a moon.

Also, if the moons had real gravity, then all objects caught in their fields ? which in the game are portrayed as glowing pellucid disks ? would accelerate towards the surface. It's hard to say if the birds follow this law, since they go through so many other inexplicable motions. But the debris they collide with clearly do not. Allain demonstrated that in the game, rocks actually slow down during their free-fall to the moons' surfaces.

And why are those moons sitting still, exactly? In space, they would not only gravitationally interact with the wayward birds, but also with each other. If intentional, it was clever for the developers of Angry Birds Space to?lock the moons in place. The conundrum of three or more bodies gravitating towards one another still perplexes physicists. They call it the n-body problem. Obviously, n-body gravitation occurs, but we have no way to theoretically explain it. Even the current models that can approximate this motion are astoundingly math-intensive.?

Criticizing an extremely fun and successful video game for its inaccuracy is easy, if not curmudgeonly. But if you're going to look to Angry Birds Space for educational value, you should know that its physics is about as accurate as its ornithology.?

With just two months before the financial year-end, now is the time to make tax-saving investments and provide their proof and other documents to your employer, helping you get you tax deductions.

Self-employed professionals need to pay their full advance tax by mid-March. ?Otherwise, you?ll be paying penal interest,? says Rajesh Srinivasan, leader of individual taxation at consulting firm Deloitte Touche Tohmatsu India Pvt.

Here are five ways to lower your tax bill this year:

1. Stock losses: The stock market?s ugly losses of 2011 have a bright side ? they can help you lower your taxes.

If you sold an equity mutual fund or individual stocks in this financial year at a loss, this is considered a capital loss, which can be offset against any capital gains you may have made, such as on the sale of property or gold.

Remember, however, that capital losses cannot be offset against your salary or other income. A short-term capital loss (for investments held for less than one year) can be offset only against a short-term capital gain, whereas a long-term capital loss can be offset against any gains.

If you don?t have capital gains this year, no worries. You can bank your capital losses and use them for the next eight years, says Mr. Srinivasan.

2. Infrastructure bonds: Introduced by India?s finance minister in 2010, these are a relatively new option for saving on taxes.

Basically, an investment of up to 20,000 rupees ($400) made into bonds issued by qualified infrastructure companies can be deducted from your taxable income. This deduction is over and above the 100,000 rupee ($2,000) deduction available under Sec 80C of the Income Tax-Act, 1961.

At the moment, issuers like L&T Infrastructure Finance Corp. and Infrastructure Development Finance Corp. have such bonds available, paying an interest of 8.7%. However, these bonds require you to be locked in for at least five years.

These bonds make most sense for individuals falling in the highest tax bracket, and who want to play safe. The interest earned on these bonds is taxable.

These are not to be confused with tax-free bonds, which have also recently been introduced. The investment in these bonds is not tax-deductible.

3. Home loan deductions: Many people don?t realize that deductions on loans taken to buy a house are available for more than one home.

If you have taken a loan for one home, interest payments of up to 150,000 rupees ($3,000) per year can be deducted from your ?income from house property.? If you live in this house, you obviously don?t have any income from it, so the interest deduction effectively results in a ?loss? from house property. This can be offset against your salary income.

If you have a second house, whether you rent it or not, it is considered to be let out for taxation purposes. You have to show a ?notional? rent or the actual rent as your income from house property. The notional rent is calculated based on factors such as the rent of similar houses in the neighborhood. From this, ?you get the deduction of the entire interest,? says Naresh Ajwani, partner at Mumbai tax firm Rashmin Sanghvi & Associates.

Interest on loans taken for repairs and renewals is also deductible for the second home, according to the Income Tax department.

You need to furnish the interest details to your employer to get the benefit in your tax deduction at source.

Note that repayment of home loan principal can be deducted only under Section 80 C, up to 100,000 rupees ($2,000).

4. Section 80C: Most individuals are well aware of this section of India?s tax law, which allows you to deduct up to 100,000 rupees ($2,000) from your taxable income by making certain types of investments. But many don?t know all that is included in this section.

Your contributions to the Employees Provident Fund, or Public Provident Fund, count toward this limit, so first check if there is any shortfall. If so, your best options are:

Equity-linked saving schemes, for young people who can handle some risk. These are mutual funds which buy stocks from a wide range of Indian sectors, and in which need you to stay invested for at least three years.

If you, like me, already own such funds, you are likely sitting on losses. But believe it or not, they are still a good option.

By buying at a lower price now, you lower the average cost of buying these funds, and boost your eventual profit. Some good options for such funds are the Franklin India Taxshield fund and Fidelity Tax Advantage.

Debt options: For ultra risk-averse individuals who are okay with lower returns but want guarantee, debt investment options include government-issued bonds called National Savings Certificates, and tax-saving fixed deposits issued by banks which are currently paying annual interest of around 8.25% to 8.75%. These options have a lock-in of five years or more.

5. Charity: If you have donated to charity in this financial year, your employer won?t be giving you the benefit of deduction. You?ll just have to apply for a refund when filing your tax return. Make sure you save all your receipts, or other proof of payment to the charitable institution.

Depending on the type of charity, you can deduct 50% or 100% of the donated amount from your income.

If you haven?t already made any charitable donations, ?this is the right time,? says Mr. Srinivasan of Deloitte.

One Perfect Bite: Irish Celery and Apple Soup

Margaret Johnson is an Irish-American writer who is a recognized authority on Irish food and drink. This passionate cook holds dual citizenship in the US and Ireland and has authored five cookbooks that explore the customs and cuisine of the Emerald Isle. Today's recipe, an adaption of an old Irish favorite, is her creation, and color alone makes it worthy of consideration for a St. Patrick's Day celebration. Fortunately, it has more than color going for it. If you enjoy the taste of celery, you will love this uniquely flavored soup that is made more interesting with help from apples that add a slightly sour aspect to the soup. The combination works well, and while I can't recommend serving this in large portions, it makes an ideal first course. I served it last weekend with an Italian-type meal that included Arista and I was really pleased at the way all the flavors came together. This is a fast, easy and inexpensive soup that is also mercifully low in calories. It can be made well-ahead of serving, though its color darkens slightly as it sits. I know those of you who are adventuresome will enjoy this palate brightener. Here's the recipe for this truly simple starter.

Ingredients:
3 tablespoons unsalted butter
1 large onion, chopped
2 garlic cloves, minced
1 bunch celery, chopped
5 Granny Smith apples, peeled, cored, and sliced
6 cups homemade chicken stock, or canned low-salt chicken broth
Salt and freshly ground pepper
1/2 cup light cream or half-and-half
2 tablespoon minced fresh parsley

Directions:

1) Melt butter in a large saucepan set over medium heat. Add onions and garlic and cook until soft, 4 to 5 minutes. Add celery and apples and cook another 5 minutes. Add stock or broth, and bring to a boil. Cover, reduce heat to a simmer, and cook, stirring occasionally, until vegetables are tender, 10 to15 minutes.
2) Transfer solids to a blender or processor and working in batches, process until smooth (I used an immersion blender for this task). Return to same saucepan and season with salt and pepper. Whisk in cream. Heat through over low heat. To serve, ladle soup into bowls and sprinkle with parsley. Yield: 10 to 12 one cup servings.

What's so super about Tuesday? 419 GOP delegates

(AP) ? Super? Maybe not this time. But it is a Tuesday, one with the biggest payout of the Republican presidential primaries.

Super Tuesday, slimmed down to half its 2008 size but still doling out one-third of the delegates needed to win, probably won't settle much.

Sure, it could nudge Newt Gingrich out of the race, or lend Ron Paul more credibility. But it won't be easy for either Mitt Romney or Rick Santorum to score a decisive advantage, because delegates are doled out by share. A close second in a state can pay off almost as well as first place.

Win some big states, especially Ohio, and the symbolism is powerful, of course.

Romney might cement the front-runner status that keeps slipping through his fingers. Santorum could prove he's the real thing.

What's at stake, what's it mean and what might happen? A Super Tuesday tip sheet:

Delegates for grabs Tuesday: 419.

Delegates already won: 353. Romney, 203; Santorum, 92; Gingrich, 33; Paul, 25.

Delegates needed for the nomination: 1,144.

Super Tuesday is super expensive:

A week's worth of heavy advertising in all 10 states would cost a candidate about $5 million.

That's a lot even for Romney's well-financed campaign, prompting him to make a plea for donations amid his Michigan victory speech. Gingrich is getting another multimillion-dollar boost from Las Vegas billionaire Sheldon Adelson, who donated the money to a special type of political action committee, known as a super PAC, that will run advertising in key states.

Ohio, Ohio, Ohio:

It's the race to watch. Political junkies get all misty-eyed over this Rust Belt swing state, and not just because of the 63 delegates.

No Republican nominee has ever become president without winning the state. That makes it a powerful proving ground for the men trying to show they can take on President Barack Obama.

It's home to Joe the Plumber and tens of thousands of auto workers, but Ohio's not all blue-collar. It's also the Rock and Roll Hall of Fame, high-tech science, medical and energy workers, suburbanites, soybean farmers and a quarter-million dairy cows (OK, the cows can't vote). The big issue is the economy, including Obama's bailout of the auto industry.

Santorum and Romney are duking it out in Ohio. Look for the outcome to generate more buzz than any other Super Tuesday contest.

Newt's last stand or Gingrich rises again?

Get out the hook for Newt Gingrich if he loses in Georgia, the state he represented in the U.S. House for two decades.

Gingrich hopes to win decisively here and pick up enough other delegates to relaunch his up-and-down campaign, which has been mostly down-and-out since he lost Florida in January. He's got endorsements from Gov. Nathan Deal and Herman Cain, a fellow Georgian. He's got a new pitch, claiming he can bring the cost of gas down to $2.50 per gallon.

Santorum is pushing hard to wrest the state's Christian conservative and tea party voters away from Gingrich. Romney remains a force, even if the state is outside his comfort zone. Georgia boasts the day's biggest cache of delegates: 76.

Elsewhere in the South:

Two other Bible Belt states, Tennessee and Oklahoma, are central to Gingrich's hopes of revival. But Santorum insists he'll be the big story in both.

In Tennessee, a confident-sounding Santorum is trying to walk the footsteps of another outspoken Christian conservative, Mike Huckabee, who won this primary four years ago. Romney boasts the support of popular Gov. Bill Haslam, while Gingrich is getting plugs from one of the state's most colorful political figures, former senator, movie actor and Law & Order star Fred Thompson. At stake are 55 delegates.

Dotted with drilling rigs and cattle ranches, Oklahoma straddles the South and the Great Plains and sits squarely among the reddest of the red states. Santorum tagged it "ground zero of the conservative movement," and his anti-abortion, pro-family values message attracts enthusiastic crowds here. The other three hopefuls also have dropped in, hoping to prove their conservative bona fides to the Okies. It offers 40 delegates.

Paul's big night?

The anti-war, libertarian-leaning, unorthodox Republican hasn't won a single state. Super Tuesday could change that.

Paul is focusing on the three caucus states ? Idaho, North Dakota and Alaska ? where a big turnout by his cadre of enthusiastic followers would have the most impact. Even if he doesn't score a win, he's likely to pick up delegates to help power him into this summer's Republican convention with enough clout to promote his ideas.

But his rivals won't make it easy.

Idaho's big Mormon population ? about a fourth of its voters ? bodes well for Romney, who's a Mormon. Santorum's looking to win in North Dakota, and Romney's trying, too.

Paul, a Texas congressman, may be the only one to journey to Alaska, however. He planned to be in the state Sunday. Meanwhile, Alaska's most famous Republican, Sarah Palin, has been saying some nice things about Gingrich.

Together, the three caucuses pay out 84 delegates.

What's the deal with Virginia?

Gingrich would love to compete in this Southern state, but he's not. Only Romney and Paul landed spots on the ballot, by having early organizations strong enough to collect the required 10,000 signatures. That leaves Virginia mostly a curiosity. What kind of showing can Paul muster going mano-a-mano with Romney? The fight is over 46 delegates.

Romney territory:

There's little drama in the Northeastern races. Romney's virtually unopposed in his power base of Massachusetts, where he was governor just over five years ago. Delegates: 38. He's expected to win neighboring Vermont handily, too, although Santorum seeks to peel away some of its 17 delegates.

Next up:

Caucuses and primaries in Kansas, Wyoming, Alabama, Hawaii, Mississippi, Missouri, Illinois and Louisiana fill out the busiest month of the nomination season. Three territories ? American Samoa, the Virgin Islands and Puerto Rico ? also get their say in March.
