Business Tools for Designers ? Mastering Negotiation ? Enterprising ...

The following is a great summary of some classic negotiation skills from former lawyer and author Matthew Swyers. During the career f any designer in any market there will be a need to negotiate. Throughout the production, distribution, and sales process, making sure your needs are meet, along with the needs of your various stakeholders will be crucial to success.

Basic Skills

1. Listen

To negotiate, you must learn how to listen and apply what you hear to formulate your next move. Every word has a purpose. Every statement a hidden tell. If you listen carefully, I mean really carefully, you will be able to hear and understand what your opponent in the negotiation truly wants. Listening is the bare minimum skill you must have to start building your abilities as a good negotiator.

2.? Be Willing to Walk Away

When two sides are negotiating, one of the other most basic skills you must retain is the ability to walk away if the deal does not satisfy your requirements. Some may think this is axiomatic, but it is not.

Once I was assisting a friend in negotiating the purchase of a new car. At the end we were close, but the dealer refused to remove some extra charge that was just more fat on the bone for his sales price. After much back-and-forth over this item, we reached an impasse: The salesman would not take it out of the price, and I would not move on him taking it out. I stood up, politely thanked him for his time, and said to my friend, ?Let?s go.?

To my surprise, my friend remained seated, turned his eyes toward me, his expression quickly changing to that of a child?s wanting a toy in a toy store, and said, ?But I really want the car.? At that point, any chance of continuing to negotiate a better deal evaporated like a puddle on a hot Southern summer afternoon. If he would have stood and walked, we would have never made it to the door before that item was taken off the cost. But by not being willing to walk away, we gave the other side a critical advantage: He knew we would not walk. Always be willing to walk away from a deal, and let it be known in either a subtle or not so subtle manner, as the situation dictates.

Intermediate Skills

1.? Feign Indifference, Don?t be Indifferent

Obviously we care about the thing we are negotiating for, otherwise there would not be a negotiation. But just as we must be willing to walk away from the deal, equally as important is that you must never let the other party know how much you want or need to make the deal.

For example, for anyone who is familiar with my other writings you may recall that I am a trial attorney who has tried hundreds of cases in my career and litigated thousands more. At some juncture during the course of litigation, the parties will discuss settlement. Irrespective of my client?s concerns and directives, I always feign indifference during settlement discussion. Why? Because if the other side ever gets a whiff that you are not willing to try the case, it will have a decided advantage over you in the negotiation process.

So no matter if my client is ready to take the case to the mat or can?t afford or does not want to move forward anymore, opposing counsel gets the same routine from me every time: ?We can try to settle the case or just go to trial. I?m good with whatever.? The goal in feigning indifference is to be as difficult to read as a blank page. In the end, however, it is a valuable skill to have in any negotiation. So you may not be indifferent, but never let them know.

2.? Have the Ammunition You Need

In litigation, this is about having your case ready to go to trial if it does not settle and making sure the other party knows you are ready. In other negotiations, such as in real estate, it?s about letting a prospective purchaser know you have another buyer on the line and that if he does not meet your terms, you?ll just sell it to the other guy. In any negotiation that involves an alternative action if the terms are not met, you must let the other party know you can, and will, do a specific act it does not want you to do in the event terms are not met. In short, let the other party know that you have your ammo and are willing to use it.

Many years ago, my then firm represented a man who had been horrifically injured by a product. Our firm was brought in to represent his interests against the manufacturer. Because of certain confidentiality provisions, I cannot mention the product or even the type of product it was. Suffice to say, however, it was the first case of its kind and had significant national exposure on not only a media level but political as well. Well, as in any litigation case, the parties are required to exchange documents whether they are detrimental or not to your case.

We knew that the defendants were holding out on us and saying that these specific very damaging reports did not exist despite the fact we had witnesses that testified to the contrary. We knew if we got our hands on these reports, they would be shaking in their boots. Well, to make a long story short while referencing a great episode from?Seinfeld,we employed a special team of people to ?retrieve? the reports for us, and ?yadda yadda yadda,? we appeared at pretrial with these ultra-damaging reports in hand. The case, one of the most contentious and longest I had ever been involved in, settled minutes later. Why? Because we had the ammo.

So it does not matter if it is litigation, real estate sales with an alternative buyer, or otherwise, always have the ammo?or appearance thereof?to support your side in the negotiation.

Advanced Skills

1.? What Motivates the Other Party? Use It

As a prerequisite, you must always listen. Listening, as stated above, is critical to hearing what the other side wants. But on a higher level, you must strive to understandwhy.?What is motivating the?why? If you can listen between the lines to understand that which truly motivates the other party, you will gain a decided advantage in the negotiation of the deal.

Chris Ford: Why I say yes to gay marriage legalisation - there's no better time than now!

?I applaud Labour MP Louisa Wall's bill to legalise same sex marriage.

It's about time that this measure came in. According to a recent Colmar Brunton/One Network News poll, 61 percent of New Zealanders stated that they backed gay marriage. New Zealand is following a shift in global opinion (at least in western democracies such as the United States and the United Kingdom) towards public acceptance of gay marriage.?

We have come along way since the days of the Homosexual Law Reform Act debates of 1985-86. In those times, heterosexual New Zealanders (including myself) couldn't openly voice our support for such reforms given the hysteria and bigotry that then surrounded gay issues. Now, 25 years later, I don't know of any straight family, friends or acquaintences who oppose gay marriage. It's a great sign of the times.

Very rarely do I applaud John Key. Today, however, I have to give him credit for considering backing the legislation all the way through Parliament. Gone are the days when the Labour, Green and Alliance parties were considered to be the so-called parties of political correctness over social conscience issues (such as civil unions). Now, I am pleased to see that many National MPs are preparing to join what can better be described as a human rights crusade on at least this issue.

This legislation will test the supposedly social liberal (and even conservative) core of other political parties, namely, ACT, Mana and New Zealand First.?

ACT, of course, is currently led by one of the most reactionary conservative politicians in New Zealand, John Banks. He is a Christian conservative and staunch gay marriage opponent leading a party largely comprised of social libertarians who believe that the State has no role interfering in the private lives of individuals. Mana is led by the Maori sovereigntist but yet socially conservative, Hone Harawira. Harawira has gone on record as being personally opposed to gay marriage but he will also have to face down socially progressive party members who are supportive of it.

Therefore, given that both Banks and Harawira are both singing from the same sheet on gay marriage while significant numbers of their respective party grassroots members aren't, this debate will test the unity of these small parties to the core. I expect that Mana will use its internal processes to decide the issue with Harawira (as Jim Anderton used to be within the Alliance and before that the NewLabour Party) expected to toe whatever becomes the agreed party line in the House. Therefore, if Mana activists vote in favour of gay marriage, then Harawira will have to go along with it despite his continuing personal opposition to the idea. Conversely, if Mana activists narrowly vote against, then such a result would suit Harawira while unsettling the social progressives within his party ranks.

Banks (on the other hand), will very strongly oppose gay marriage and given the propensity of conservative parties (like Act) to permit conscience votes on moral issues, will cast one. This likely outcome will unsettle what remains of the ACT Party's activist base (particularly within its campus branches) leading to further rumblings against Banks. And even New Zealand First's internal unity could be on the line as its caucas wrestles over which way to vote or as to even whether to grant its MPs a conscience vote at all. In fact, which way New Zealand First votes could be crucial to the outcome. I expect that with an eye to the next election, the majority of their MPs (if given a conscience vote or if they agree to vote collectively) could vote no on the basis that they fear competition from the fundamentalist Christian-sympathising Conservative Party. But even if one or two New Zealand First MPs vote positively (provided that their MPs are given a conscience vote) then it could be enough to secure the passage of the legislation.

The gay marriage legislation will no doubt excite the Christian (and other religious) fundamentalist base as well.

Family First have already launched an anti-gay marriage campaign and Destiny Church could see the issue as providing fertile ground for a new recruiting campaign for their cult. I expect that for the established and comparatively more progressive mainstream churches (such as the Presbyterian, Anglican, Methodist and Baptist denominations) this issue could further test their internal unity with factions coming out both for and against the legislation. The Roman Catholic Church and the Salvation Army will unreservedly (and disappointingly) say no as they have on other issues regarding gay, lesbian, bisexual and transgendered rights regardless of how many of their respective congregants support the measure. And other faith communities (including Islam, Hinduism, Buddhism and conservative Jews) will come out against gay marriage as well.

Clearly, this legislation is the most significant legal barrier that remains to be crossed by this country's GLBT community. ?If Parliament passes this measure, then we will send a loud message that bigotry can't be tolerated in Aotearoa/New Zealand. And more New Zealanders are prepared to say just that about GLBT rights!

Could outsourcing of U.S. jobs actually be good for Americans?

The number of U.S. jobs lost to low-wage countries has never been officially calculated ? U.S. companies are not legally mandated to report such statistics. Boston-based global research and advisory firm Forrester predicts that more than 400,000 service jobs have been moved offshore since 2000 ? and that number will rise to 3.3 million by 2015. More than 2 million manufacturing jobs have been outsourced abroad since 1983. Economists estimate that the number of jobs leaving the U.S. ranges between 12,000 to 20,000 per month.

Relocated U.S. jobs end up going to workers in developing nations like China and India, countries that pay their employees much less than their American counterparts.

Michael Tanner, a senior fellow at the libertarian think-tank Cato Institute, argues that low-skill jobs (such as product assembly and call centers) are not cost effective for U.S. companies anymore. In an interview with The Daily Ticker, Tanner says outsourcing has allowed U.S. companies to penetrate foreign markets, be more competitive and hire more U.S. workers at home.

"Countries outsource to establish a presence in a country in which they plan to do business," he says in the accompanying video. "If we're going to sell cars in China it makes sense to build a plant in China." Overseas profits are brought back to the U.S. "and then those new profits enable them to hire new and more skilled jobs in this country."

Outsourcing: On The Campaign Trail

Republican presidential candidate Mitt Romney has come under withering attacks that his former employer Bain Capital "offshored" thousands of U.S. jobs; whether those layoffs occurred during Romney's tenure at the private equity firm is debatable.

Tanner says Romney should stop fighting allegations that he was responsible for shedding U.S. jobs and embrace the practice of outsourcing on the campaign trail.

"Mitt Romney shouldn't run away from the fact that he ran a profitable business," Tanner notes. "Romney should point out all the good things that came from his investments at Bain. The companies he managed money for included union pension funds, endowments for universities and charities. Simply making stocks go up makes everybody's 401k bigger."

The Obama campaign contends that Bain Capital, under Romney's leadership, shipped U.S. jobs overseas to reduce costs and earn a profit at the companies it owned. Vice President Joe Biden, speaking in Ohio last week, addressed Romney's record as a job creator.

"I honest to God think it's totally appropriate to judge whether he was a job creator, and if he did create them, where did he create the jobs?" Biden said. "I have to admit, after really going into detail, that he did create jobs. But they were in Singapore, China, India. They weren't in Michigan, Ohio, Pennsylvania."

According to a June 21 Washington Post article, Bain Capital purportedly "invested in a series of firms that specialized in relocating jobs done by American workers?companies that were pioneers in the practice of shipping work from the United States to overseas call centers and factories making computer components" during the nearly 15 years that Romney was actively involved in running Bain.

Outsourcing: Is Any Job Safe?

U.S. multinationals cut their work forces in the U.S. by 2.9 million during the 2000s while increasing employment overseas by 2.4 million, according to the U.S. Commerce Department. U.S. corporations employed more than 21 million people in the U.S. and 10.3 million workers abroad in 2009.

Blue-collar jobs are not the sole casualty of outsourcing. The McKinsey Global Institute predicts white-collar offshoring will increase at a rate of 30 percent to 40 percent over the next five years; those jobs could include "back office" jobs such as accounting and payroll processing.

Accounting in Poland, business venture


Hello,

I wonder this:

All small business must pay tax in Poland (like in practically all other countries). The way they find out how much they should pay in tax is by doing accounting/bookkeeping.

Many small business owners in Poland aren't into this, doesn't like it or doesn't know how to do it - so they buy help from bookkeeping companies. In Norway it's normal that many in industries such as cafeterias, decorators and used car sellers, buy bookkeeping services from small bookkeeping companies.

So, my question is, for such services, how much do they normally have to pay per hour?

And, there are differences in what education is needed to be allowed to help small business with accounting. In Germany the accounting education needed is a couple of years in a high school teaching accounting, and in Norway the law says that in order to help small business (and all business) you need at least three years in college plus several years as some sort of "trainee".

What does the law say in Poland about what's required of education to be allowed to do accounting?

AURORA, Colo. (AP) ? A Colorado suburb shocked and saddened by a deadly shooting spree at a midnight unveiling of the latest Batman movie grieved for the victims while authorities sought a motive and a safe way to reach clues inside the suspect's apartment, still apparently rigged with an elaborate booby trap.

Police grimly went door to door late Friday with a list of the victims killed in the worst mass shooting in the U.S. in recent years, notifying families who had held out anxious hope that their loved ones had been spared inside the packed theater near Denver.

Twelve people died and 58 were injured in the attack early Friday, a few of those not by gunfire but in the chaos that ensued as the audience tried to flee the smoke-filled theater, authorities said. Among the wounded, 11 were listed in critical condition.

The deceased victims included 23-year-old Micayla Medek, said Anita Busch, the cousin of Medek's father. The family took the news hard, but knowing her fate after waiting without word brought them some peace, Busch said.

"I hope this evil act, that this evil man doesn't shake people's faith in God," she said.

Besides Medek, relatives confirmed that Alex Sullivan and Jessica Ghawi were among those killed, Sullivan on his 27th birthday.

Hours after the shootings, it remained unclear what drove the suspect, identified as 24-year-old James Holmes, to fire round after round at the unsuspecting audience watching "The Dark Knight Rises." Aurora Police Chief Dan Oates said Holmes used a military-style semi-automatic rifle, a shotgun and a pistol that he had bought at local gun stores within the last two months. He also recently purchased 6,000 rounds of ammunition over the Internet, the chief said.

The suspect's stellar academic record, apparent shy demeanor and lack of a criminal background made the attack even more difficult to fathom.

It also wasn't known why the suspect chose a movie theater to stage the assault, or whether he intended some twisted, symbolic link to the film itself.

The new Batman movie, the last in the trilogy starring Christian Bale, opened worldwide Friday with midnight showings in the U.S. The plot has the villain Bane facing Bale's Caped Crusader with a nuclear weapon that could destroy all of fictional Gotham.

In New York City, Police Commissioner Raymond Kelly said: "It clearly looks like a deranged individual. He has his hair painted red. He said he was the Joker, obviously the enemy of Batman."

Oates would not confirm that information, but did say he had spoken to Kelly. The two used to work together in New York. Asked whether Holmes had makeup to look like the Joker, Oates said: "That to my knowledge is not true."

Near the entrance to the Aurora theater's parking lot, a makeshift memorial of 12 candles sat in a row near piles of flowers. Up the hill, about 20 pastors led an emotional vigil for about 350 people, some hugging and crying. A sign read, "7/20. Gone Not Forgotten."

An emotional Gov. John Hickenlooper said earlier Friday that people would not be defined by the tragedy.

"We are clear that we are going to rise back and lift ourselves above this," he said.

A federal law enforcement official said Holmes bought a ticket to "The Dark Knight Rises," went into the theater as part of the crowd and propped open an exit door as the movie was playing. The suspect then donned protective ballistic gear and opened fire, the official said, speaking on condition of anonymity to discuss the ongoing investigation.

Authorities said he hit scores of people, picking off people who tried to flee. At least one person was struck in an adjacent theater by gunfire that went through the wall. Adding to the terror and chaos were gas canisters thrown by the suspect that filled the packed suburban Denver theater with smoke.

Tanner Coon, a 17-year-old Aurora resident who was watching the film with two friends, said he first thought the gunshots were firecrackers. When he realized what was happening, he ducked between the seats and waited for the shooter to say what he wanted.

"When is he going to start telling us what to do? When is this going to become a hostage situation?" Coon said.

When the firing ended, Coon said he started running up the row but slipped in blood and fell on top of a woman who was lying on the ground. He tried shaking her, he said, but she didn't respond, so he left her behind and ran out of the theater.

Within minutes, frantic 911 calls brought some 200 police officers, ambulances and emergency crews to the theater. Holmes was captured in the parking lot. Police said they later found that his nearby apartment was booby trapped and ordered other residents in the building and surrounding homes out of the area.

Police were not able to enter the apartment Friday night and Oates said they will try again on Saturday.

"It is a very vexing problem how to enter that apartment safely," he said.

Kaitlyn Fonzi, a graduate student at University Hospital who lives in the apartment below, said she heard loud music coming from that unit apartment. She went upstairs and put her hand on the door handle. She felt it was unlocked, but she didn't know if he was there and decided not to confront him.

Fonzi called police, who told her they were busy with a shooting and did not have time to respond to a noise disturbance. She said she was shaken to learn later that the apartment was booby trapped.

"I'm concerned if I had opened the door, I would have set it off," she said.

The shooting was the worst in the U.S. since the Nov. 5, 2009, attack at Fort Hood, Texas. An Army psychiatrist was charged with killing 13 soldiers and civilians and wounding more than two dozen others. It was the deadliest in Colorado since the 1999 attack at Columbine High School, where two students killed 12 classmates and a teacher and wounded 26 others before killing themselves.

Holmes had enrolled last year in a neuroscience Ph.D. program at the University of Colorado-Denver, though he left the program last month for unknown reasons. In academic achievement, "he was at the top of the top," recalled Timothy P. White, chancellor at the University of California, Riverside, where Holmes earned his undergraduate degree before attending the Denver school.

Those who knew Holmes described him as a shy, intelligent person raised in California by parents who were active in their well-to-do suburban neighborhood in San Diego. Holmes played soccer at Westview High School and ran cross-country before going to college.

Police released a statement from his family Friday that said, "Our hearts go out to those who were involved in this tragedy and to the families and friends of those involved."

I cannot remember a time when I did not have a pencil and paper in my hand. It seems writing has always been a part of my daily life. And when I was not writing about something, I was reading. Writing and reading have always been a priority in my life. Reading takes me into different places, some near and some far. As I read I become acquainted with characters whom I may never meet in real life, but I have met them through novels and short stories. Some characters I read about remind me of myself or other people I know.

When I was a little girl I remember telling my mother I wanted to learn how to read and write in Spanish. Every day a neighborhood boy would come to our house and sell my mother a Spanish newspaper for five cents. I would sit next to my mother and watch her read.

One day we went to the grocery store to buy groceries. At that time groceries were bagged in brown paper bags. My mother cut out a piece of the brown paper bag after we put all of our groceries away. Next, she drew lines on it with a ruler. Then, she took out an old Spanish newspaper she had already read. She cut out an article with the scissors. Finally, she told me to sit at the kitchen table and write the article at least two times. She kept this up until I learned how to read and write in Spanish.

Several years passed and I soon became a Mother. My mother would babysit my daughter. My daughter told me her grandmother was teaching her how to speak Spanish. I told her that was good. I went on to tell her how her grandmother had taught me also when I was a little girl too.

After a while I began to wonder how my mother was teaching my daughter the Spanish language since we didn?t get any more brown paper bags at the grocery store. Nowadays our groceries were bagged in plastic or recyclable bags.

I got the answer one day. I went to my mother?s house to pick up my daughter. My mother had been babysitting for me. As I walked into my mother?s house I walked in as they were both watching television. The channel was set to a Spanish soap opera. I stood there for a few minutes watching. My daughter turned to look at me and said, ?I?m glad you?re here Mom. You?re just in time for my Spanish lesson.?

My mother was teaching Spanish to my daughter via a form of technology ? the good old television. I was happy to see this. Needless to say, my daughter learned Spanish.

The saying that our mothers are our first teachers is true for me!

British troops have to provide Olympics security after contractor fails

LONDON ? Now the British military is being asked to ?mind the gap? ? in security.

London?s Olympic organizers reeled Friday from the fallout of revelations that 3,500 British troops? some of them just back from tours in Afghanistan ? would need to step in and help guard venues for the upcoming Olympics. That?s because the security contractor, G4S, failed in its promise to deliver more than 10,000 security guards ? and didn?t let anyone know until the last moment.

With only two weeks to go before the games, the embarrassing development made organizers squirm. London games chair Sebastian Coe, who had sailed on a cascade of positive news so far, found himself trying to explain why the games? sole security provider and a sponsor had produced such a mess.

?It?s only when the rubber hits the road that you understand some of things that you need (to) address,? Coe told reporters Friday. ?When the rubber hit the road and we looked at some of the retention, some of the recruitment ? we made a very quick and very robust and prudent and judicious decision to act as we did.?

The problems started to emerge only a few weeks ago. G4S failed to provide enough security guards when the stadium and the aquatics center were ?locked down?? a process that involves putting in place the tightest security ahead of the games. The government started asking questions and as late as Wednesday, G4S was suggesting they could still deliver. By Thursday, Home Secretary Theresa May was facing lawmakers outraged about the debacle and the decision to send in more troops, bringing the total number of armed forces involved in the project to 17,000.

Security has been a critical concern for the Olympics ever since 11 Israeli athletes and coaches died in a terror attack at the 1972 Munich Games. British authorities have planned for a threat level for the London games of ?severe,? meaning an attack is ?highly likely.?

London itself has also been touched by terrorism, when four suicide bombers killed 52 commuters on July 7, 2005 ? the day after London was awarded the games. A huge international media presence makes the Olympics a prime target for any terror group intent on wreaking havoc on live events broadcast worldwide.

Some security analysts suggested the games might be better off by having servicemen and women around rather than guards whose training might be substandard.

While the guards issue centers on securing the venues, critics wondered whether the tone of overall securityfor the games will shift. National Olympic security coordinator, Chris Allison, wants it to be remembered as a blue games ? or dominated by police ? rather than a khaki games ? or something like the militarized look of Beijing.

?We still have many many more G4S people on this site at this very moment than the military,? Coe said while on a tour of the new water polo arena.

He suggested that athletes would be unconcerned about the changes.

?I?ve never seen athletes of any level, either from university sport or Olympic finalists, breaking off their warm-up routines to go and have their photographs taken with the military.?

It was not the first time the security mix needed to be changed for games costing the British taxpayer 9.3 billion pounds ($14.6 billion). The total cost of securing the venues climbed to over 553 million pounds ($862 million) ? not including money for the police or the new cost added by the soldiers.

Critics demanded that G4S face fines ? and even Prime Minister David Cameron said companies who don?t deliver on their contracts should be ?be pursued for that money.?

G4S, which has over 657,000 employees operating in more than 125 countries, chalked up the problems to issues vetting and recruiting staff. But comments from apparent applicants posted online painted a picture of broad-based mismanagement, disorganization and even squandered opportunities.

Potential guards took to the company?s Olympics Facebook page to plead for information about where their accreditation passes and uniforms were. Others wondered when they would get their shifts, why they had been approved and vetted but not received any more details on when to turn up and how they would be employed.

Applicant Jimmy Schofield, 32, said he had been bogged down in the hiring process since March.

?I feel like pulling my hair out,? he said. ?All l want to do is work. I turned down job offers because l was told l would be working at the Olympics.?

Some potential guards were angry and said they had been vetted and qualified but never received marching orders ? only to learn that the armed forces would be called in. Others had been vetted but still needed training.

As early as last year, Britain?s National Audit Office was warning that ?the need for additional manpower has also produced a significant recruitment challenge.?

?They over-extended themselves,? said Peter Fussey, author of ?Securing and Sustaining the Olympic City,? and an expert on security and the Olympics. ?This was very foreseeable.?

Coe told reporters the shortfall would not harm the reputation of the London Games.

?Good competitors never worry about what the crowd is doing,? said the former track star who owns twoOlympic gold medals. ?I?ve never ever heard, listened, seen people sitting in the stand when I was a competitor. That?s something that goes on out there. We just deliver regardless of who is there.?

(AP) ? San Francisco, the city that regulated Happy Meal toys and banned plastic grocery bags, has a new target in its health-conscious, eco-friendly crosshairs: plastic water bottles.

City officials are considering an ordinance that would require owners of new and renovated buildings with water fountains to install special bottle-filling taps. The law's designed to encourage thirsty people to refill containers instead of reaching for another bottle of Evian or Aquafina.

"This is the appropriate next step to make it easier for San Franciscans to get out of the bad habit of using environmentally wasteful plastic water bottles and into the good habit of using reusable water containers," said Board of Supervisors President David Chiu, who introduced the legislation in June.

Bottle-filling taps like the ones that would be required if Chiu's measure passes already are found at San Francisco International Airport and at some city parks and schools. Installed behind a drinking fountain's regular faucet, they dispense chilled water in a quick-streaming vertical jet that is high enough to accommodate most water containers.

Advocates say having bottle-specific spigots encourages the reuse of water bottles by eliminating long waits to fill them and removing concerns about germs. Some people squirm at the thought of drinking from a fountain exposed to so many mouths, although city officials say water fountains are no less hygienic than bottle taps.

Skeptics question whether the ordinance is necessary, since the proposed taps pour the same highly-regarded public water that comes out of every other faucet and drinking fountain. Businesses often complain that San Francisco lawmakers are too quick to impose bans or restrictions that affect their bottom lines.

"If you are in an office, your kitchen has a sink, the sink has a faucet and that faucet puts out Hetch Hetchy (reservoir) water," San Francisco Building Owners and Managers Association representative Ken Cleaveland said. "It's just one more new law that San Francisco is implementing on top of hundreds of other laws to make, rather force, compliance in sustainable practices."

Despite initial skepticism, the association is waiting for more details before taking a stance on the law

Adding a bottled-water spigot to existing water fountains would cost at least around $750, according to manufacturers.

For officials at Pennsylvania State University, the cost has been worthwhile. The university is now installing taps on all its campuses after experimenting with them for three years, said Lydia Vandenbergh, an official overseeing the university's effort to reduce use of plastic water bottles. Students were more receptive to filling bottles from special taps than drinking fountains, thought to be dirty.

"In the era of hyper hygiene, for a lot of people, that's a barrier," Vandenbergh said. University officials have estimated the busiest tap replaces the equivalent of 35,000 plastic bottles a month.

Chiu's ordinance calls plastic water bottles "bad for the environment," unnecessarily taking up landfill space and causing greenhouse gas emissions when cheap tap water is available. San Francisco city departments have been barred from buying plastic water bottles since 2007.

Chiu said he considered other aggressive measures to curb the bottle, including a fee and an outright ban. The proposed ordinance is less severe and is meant to raise awareness about drinking tap water as an alternative, he said.

Environmental groups are supportive of efforts to wean San Franciscans from plastic water bottles.

"San Francisco has among the best drinking water in country. It's ridiculous that people would go out and spend their now very limited dollars to buy bottled water," said Mae Wu, an attorney with the Natural Resources Defense Council.

Chris Hogan, an International Bottled Water Association spokesman, said his industry contributes a small fraction of worldwide energy consumption and greenhouse gas emissions. He welcomed efforts to encourage drinking tap water, but said they don't require demonizing bottled water.

"When you make the argument to discourage people from drinking bottled water, you are removing the healthiest option when it comes to choosing a bottled beverage," Hogan said.

Chiu introduced the ordinance at a board of supervisors meeting on June 26. It is expected to go before the supervisors' Land Use and Economic Development Committee in September and if it passes, on to the full board of supervisors.
